  1. What is the lawsuit about?
    Consumer advocacy in the 1990s prompted MLS organizations, under NAR agreements, to ensure clear compensation offers for buyer's agents. However, recent legal action is leading to changes, potentially shifting the responsibility of paying buyer's agents' fees to buyers if sellers opt out of offering compensation through the MLS.

  2. Isn’t working with a buyer’s agent free?

    In the past, the buyer's agents' compensation was indirectly covered by the seller, included in the home's purchase price. However, with changes, if sellers opt out of compensating buyer's agents, buyers will need to pay their agent's fee directly.

  3. If I have to pay the compensation myself, will home prices be lower?

    In a free market, home prices are primarily influenced by factors like inventory, demand, interest rates, and economic conditions, rather than agent commissions. While reducing commissions might slightly affect home prices, the main reason for decreasing affordability is the significant rise in home values over recent years.

  4. Will I need a buyer’s agent anymore?
    In real estate transactions, there are typically two agents: the listing agent representing the seller and the buyer's agent representing the buyer, ensuring separate representation. Dual agency, where one party represents both sides, is controversial and legally restricted in some areas due to potential conflicts and litigation risks, with separate representation for buyers generally recommended even where allowed.

  5. Do I have to sign an agreement?

    After the new rules take effect, most buyers will need to sign agreements to work with a buyer's agent, similar to how sellers already sign agreements with listing agents. While this practice varies across states, it will become mandatory everywhere, except for open houses, where agreements won't be required unless buyers want to revisit with their agent.

  6. Can I finance my buyer agent’s commission?

    In certain local markets, buyers can negotiate for sellers to provide credits toward closing costs, but in highly competitive areas, sellers may be less likely to agree. While there were concerns about seller compensation for buyer agents falling under financing concession limits, federal housing regulators clarified that such payments are exempt from these restrictions.

Hawaii’s Vacation Rental Restrictions

In a significant move to tackle the housing shortage exacerbated by last summer's catastrophic wildfire, Hawaii lawmakers have passed a pivotal piece of legislation, SB2919. Signed into law by Governor Josh Green, this bill empowers local counties to amend zoning ordinances, enabling the conversion of short-term vacation rentals into long-term residential housing.

The tragic wildfire in August not only ravaged the historic town of Lahaina but also revealed a critical issue: a substantial portion of the town’s housing had been transformed into short-term rentals, predominantly owned by non-residents.

Governor Green emphasized the severity of the situation in a press conference, stating, "This fire uncovered a clear truth, which is: we have too many short-term rentals owned by too many individuals on the mainland."

FCC Changes You Need to Know if Using Paid Leads

Curtis Fenn, the President of REDX has pointed out that there are new regulations affecting email communications from providers like Gmail and Yahoo, which took effect in February 2023. "They’re saying we don’t want you to email a person who doesn’t want to get your email. The whole idea is you must have a relationship with the person you want to communicate with," Fenn explained.

Fenn explains the complexity of interpreting these regulations: "I’m not an attorney and I’m not your broker. Everybody is interpreting these a little bit differently." He advises agents to consult with legal counsel and consider the consumer's preferences in their strategies.

The bottom line: OWN, don’t rent your funnel. Not only will this help comply with new regulations and foster a more personal connection with potential clients, but it will also help develop a more referral-based business.
